TERMS AND CONDITIONS :

1) PRICES

Prices are in Singapore Dollars, unless otherwise stated in other currencies.

2) GST

All prices quoted are subject to prevailing Government Goods and Services Tax.

3) VALIDITY

This pricelist supersedes previous pricelist. Prices may change without prior notice, which includes import duties, GST, major currency fluctuations and/or the Management’s price revision.

In these circumstances, prices will be adjusted with immediate effect and the Management is under no obligation to update customers’ pricelist. Prices are final when goods invoiced are received & acknowledged by the customer upon delivery.

We strongly recommend all orders be placed either by mail or WhatsApp. We do not guarantee receipt of orders sent to us unless there is a written acknowledgement from our sales representatives.

All indent orders must be supported by a written purchase order and cannot be cancelled nor rejected by customer.

Orders for out-of-stock items may be substituted with equivalent products subject to customer’s approval.

To avoid any misunderstanding, miscommunication, and wrong orders, please use the products’ item code when placing order.

5) DELIVERY

All goods are rendered within the mainland Singapore, unless specified. No delivery charge for orders minimum amount of $150. A delivery charge of $30 will be imposed on orders below this minimum amount. Gelmax shall not be obliged to deliver the goods to customers but may do so as its sole discretion.

6) NON-CONFORMITY

It is the customers’ responsibility to check all items upon delivery. The customer has the right to return any nonconforming goods for replacement by GELMAX PTE LTD., including redelivery cost, provided the claim of shortage or damage is reported immediately upon goods receipt. Once the delivery of goods has been acknowledged by customer, any damage or shortfall shall be deemed to have occurred thereafter. All product images shown in our catalogue are for illustration purposes and may not reflect actual packaging.

7) NON-RETURNABLE

Products sold are non-returnable.

8) RETURNS, EXCHANGES OF DAMAGED GOODS/BREAKAGES

Customers’ receiving personnel are advised to inspect damage/breakage during delivery and return to driver on the spot. Customers’ are to report/contact our sales or customer service without delay for exchange. Upon signing the delivery order, the customer accepts and confirms that the goods have been inspected, are according to description, and are otherwise in good order and condition. Upon acknowledgement of invoice, claims on breakage will not be accepted a day after invoice date.

9) VINTAGES

Vintages can change without prior notice.

10) PAYMENTS

Unless the customer has an approved credit account with Gelmax, payments must be made in full at the time of delivery of goods; failing, Gelmax serves the right to retail the goods, without prejudice to any of its other rights. Gelmax also reserves the right to change payment terms and conditions without prior notice.

11) RETENTION OF TITLE

The legal and beneficial title to the goods shall remain solely and absolutely with Gelmax until full payment for the goods is received. In consideration of the company extending credit to the client, the director(s) of the client company shall act as a personal guarantor, ensuring the payment of all invoices and debts owed to the company, and shall be personally liable in the event of default by the client.

12) RISK

Notwithstanding anything herein, the risk of goods sold or supplied by Gelmax shall pass to the customer upon delivery of such goods to them.

13) INVOICE

S An administrative fee of $10 per copy will charged in the event that Gelmax is requested to provide a duplicate copy of its invoice to the customer.

14) ARREARS

An interest rate of 1.5% per month will be imposed on overdue invoices. As well as goods that have been invoiced but not paid for in full will remain property of Gelmax and Gelmax retains the right to repossess such goods. Customer shall bear all the costs incurred for the recovery of late payments and Gelmax property.

15) WARRANTY

Gelmax liability is limited to replacement of goods or refund of the purchase price at Gelmax sole discretion. No other warranty expressed or implied is made by Gelmax and none shall be imputed or presumed.

16) FORCE MAJEURE

Gelmax may, without liability, delay performance or cancel this pricelist on account of force majeure or other circumstances beyond its control, including, but not limited to strikes, acts of God, political unrest, embargo, failure of source of supply, casualty, or flight (vessel/airline) cancellation.

17) GOVERNING LAW

All disputes are subjected to the Laws of the Republic of Singapore.
